Professional WEEE system

PROFESSIONAL WEEE: Waste products from the administrative or economic activities other than those other than private households

On an operational level, the parties’ duties and responsibilities for the management of professional WEEE can be charted like this:

HISTORICAL PROFESSIONAL WEEE

NEW PROFESSIONAL WEEE
From equipment put on the market before 1 January 2009

From equipment put on the market after 1 January 2009

Individual or collective management

The producer is obliged to withdraw the WEEE only when he sells an equivalent item of EEE in substitution

Individual or collective management

The producer is obliged to withdraw the WEEE even if he does not sell an equivalent item of EEE in substitution

For the management of historical professional WEEE the financing of the collection, transport, recovery and disposal of the waste is at the producer’s expense when supplying a new item of electrical and electronic equipment in substitution for a product of equivalent type and used for the same functions as the new equipment supplied at the time the professional user expresses the desire to get rid of the product.

This measure is regardless of the brand of the WEEE.

The relationship is therefore between producer and user of professional equipment, without any involvement on the part of the trader.

In other words, the user may freely decide whether or not to request the producer to withdraw the WEEE and the producer is obliged to guarantee the take back of the product that has become waste exclusively when the equipment’s professional user has expressed that desire.

For the management of the new professional WEEE, "The financing of the collection, transport, recovery and disposal of the waste is at the producer’s expense who takes on the responsibility for the products which he has put on the market from the previously mentioned date ".

The producer must:

  • arrange for the management of their brand’s WEEE even if the user does not purchase any new equipment;
  • provide adequate guarantees for the management of “future” WEEE at the time of putting the equipment on the market.
