Batteries: Producers

The legislative decree D.lgs 188/2008 in Article 2 Paragraph 1 defines:

n) «producer»: anyone who places batteries or accumulators, including those incorporated into appliances or vehicles, on the market for the first time on a professional basis, irrespective of the selling technique used, including by means of distance communication, as defined by Articles 50, and following, of the legislative decree no. 206 of 6 September 2005, transposing directive 97/7/EC concerning the protection of consumers on the subject of distance contracts;

As defined by the legislation, the “producer” of batteries and accumulators is the party responsible for the first sale or importation on the Italian market of:

  • batteries, button cells (also very small ones);
  • battery packs;
  • portable accumulators
  • industrial and automotive accumulators.

As a result, the direct importation without intermediaries onto the Italian market of appliances in which batteries or accumulators are incorporated also means that the importing party falls into the definition of “producer” of batteries/accumulators, thus becoming the recipient of the obligations and duties of this legislation.

The “producer” of batteries and accumulators must subsidize all the operations set out in the management system of this waste, from information to the public to the collection of separated waste, as well as financing the creation of systems for the treatment and recycling of waste batteries and accumulators.

In brief, the “producer” must:

  1. enrol by 18 September 2009 on the National Register of Producers, declaring at the same time the figures for placement on the market of batteries and accumulators (by weight and number of pieces) in 2008 or the provisional figures for 2009 (if the placement on the market started in 2009).
    Following enrolment, the enrolment number on the Batteries Register will be issued, and this must be included on invoices and transport documentation within 30 days of the issue date..
  2. decide whether to organize and incur the costs of the batteries and accumulators collection systems on the alternative bases of:
    • individual – enrolling directly at the coordination centre and organizing himself an adequate network of service providers;
    • collective – joining a consortium.
