The legislative decree D.lgs 188/2008 in Article 2 Paragraph 1 Letter o) defines:
"distributor": anyone who, in a commercial context, supplies batteries and accumulators to an end user;
As defined by the legislation, the "distributor" of batteries and accumulators is the party responsible for the direct sale to an end user (consumer) of batteries, batteries, button cells (also very small ones), battery packs, portable industrial and automotive accumulators
Up to today the legislation does not set out a minimum level of sales quantities/turnover under which the distribution point may consider itself exempt from the definition of the law and its obligations.
The distributors must:
- make containers for the collection of batteries/accumulators available to the public, in their sales point;
- show notices to the public regarding the possibility of delivering the waste batteries/accumulators to the collection points set up in the sales locations; this notice must contain information about the damage to the environment and health from the incorrect disposal of waste and about the sign on the product.
